The right to be forgotten and removal of medical selection questionnaire when purchasing a main residence: greater equality in accessing home ownership

Crédit Mutuel Alliance Fédérale welcomes the decisions by the members of parliament and the senate on reducing the time before a person can exercise the right to be forgotten and on the removal of medical selection in the process of purchasing a main residence: progress for anyone suffering from an illness now or in the past, and their families.

The reduction in the time before a person can exercise their right to be forgotten is a social step forward for any person who has suffered in the past from cancer or hepatitis C. Crédit Mutuel Alliance Fédérale wants AERAS to extend this reduction to include people suffering from HIV and cystic fibrosis.

By removing the requirement to complete a health questionnaire when taking out a home loan up to €200,000, this parliamentary decision also answers a great need among the families of any person suffering from a serious illness today or who has done so in the past and because of which they have been forced to abandon plans to purchase a home. At a time when people are living longer and entering the job market later, the health questionnaire had become a discriminating factor, in particular for people suffering from chronic disease (cardiovascular or endocrine disease such as diabetes, infectious disease such as AIDS, cancer, etc.).

A forerunner since 1971 in the provision of insurance that spreads risk for the benefit of all, in November 2021, Crédit Mutuel¹ became the first insurance provider to completely remove the health questionnaire for its loyal customers when purchasing their main residence, capped at €500,000 per borrower. Such an approach hinges on a rapport of trust and loyalty, the very essence of its mutualist model. As at December 1, 2021, 91,000 Crédit Mutuel customers had already benefited from this offer. Up until now, 21,000 customers had been subject to additional premiums, 66,000 customers were subject to exclusions, and 4,000 customers had been subject to both additional premiums and exclusions. Over the full year, we estimate that 150,000 loyal customers will benefit from this offer.

Crédit Mutuel Alliance Fédérale is ready to discontinue medical selection for everyone for loans up to €200,000 once the implementing decrees have been published. It wishes, however, to see affirmation that the text applies solely to the main residence and not to real estate investments or secondary residences.

Crédit Mutuel Alliance Fédérale is also calling on the supervisory authorities to exercise strict control over the right to infra-annual cancellation of insurance which is open in particular to young people in good health and overlooks people in their fifties or with an illness: such discriminatory practices by certain brokers based on age or health status must stop, as must misleading commercial practices.
They serve to diminish the social and republican foundation of our society and also harm the insurance profession. The infra-annual cancellation must not lead to an increase in such regrettable practices.

Among the 91,000 beneficiaries of the Crédit Mutuel1 offer since December 1, 2021:

Catherine, age 34, borrowed €191,000 over 25 years
She paid an additional premium of €19 per month because she has severe asthma.
The effects of her asthma were also excluded from her cover.
As of now, she will no longer pay the additional premium and the effects and consequences of her asthma will be covered.

Amel, age 36, borrowed €143,000 over 23 years
She paid an additional premium of €24 per month because she recently suffered a heart attack; she will no longer pay this additional amount. In addition, heart and vascular diseases were excluded from her cover. She will now be covered for these disorders.

Patrick, age 60, borrowed €125,000 over 15 years
He paid an additional premium of €52 per month because of his diabetes. He will no longer pay this additional amount.

Jean-Marc, age 59, and Christine, age 55, borrowed €168,000 over 25 years
The couple paid an additional premium of €45 per month based on Christine's high BMI3. They will no longer pay this amount.
In addition, Jean-Marc was subject to an exclusion of esophageal, gastric and duodenal disorders after suffering from an ulcer. These disorders are now covered.

Renaud, age 31, borrowed €198,000 over 20 years
He paid an additional premium of €34 per month because of his diabetes. He will no longer pay this additional amount.

Juliette, age 37, borrowed €290,000 over 20 years
She was subject to an exclusion of the effects and consequences of an accident she suffered in 2018.
Any sick leave linked to this accident will now be covered.

Dimitri, age 32, borrowed €156,000 over 16 years
He was subject to an exclusion relating to the effects of osteoarthritis in the shoulder.
These disorders are now covered.


Note that the removal of the health questionnaire is applicable at Crédit Mutuel under the following conditions:
  • It is reserved for customers whose main income has been credited directly to Crédit Mutuel1 for seven years;
  • An insured amount of up to €500,000 per borrower;
  • The policyholder is under 62 when taking out the policy.
